Public Hearing of
August 18, 2004

I.      CALL TO ORDER - 8:00 p.m.

        The property owner’s engineer, Michael Perrault of P.M.P. Associates of East Bridgewater told the Board that he wished to proceed with the public hearing even though only four members were in attendance.  He said that he had spoken with his client who indicated he wished to go forward so that he can start building his new house in the fall.

        Mr. Perrault said that the most recent set of plans submitted address the issues raised by the Board’s consultant as well as those raised by other town agencies.  He said that an order of conditions has been issued by the Conservation Commission for the subdivision and that talks have been initiated with the Water Department.  One issue Mr. Perrault said he wanted to discuss with the Board was fire hydrants.  The Board’s regulation requires a distance of no more than 500 feet between fire hydrants.  The nearest fire hydrant from the proposed building, he said, is less than 500 feet away. The Fire Chief has recommended that a six inch main and a fire hydrant be placed near the driveway to the proposed residence and Water Superintendent Glen Doherty is in agreement.  Perrault noted that waivers have been requested on the hydrant and water main issues. Mr. Perrault noted that the drainage had been revised to show added drainage features, reflectors at the end of the street, catch basins with grates and all other issues the Board requested.  

        Chairman Philip Lindquist noted that since the last hearing sessions, in addition to the revised plans and copy of the Order of Conditions from the Hanson Conservation Commission submitted by P.M.P. Associates, communications had been received from the Hanson Police Department, the Board’s consulting engineer, Water Superintendent Glen Doherty, and Board Member Joan DiLillo.  The July 19, 2004 letter from Police Lieutenant Richard Gredler stated that he had no safety concerns and believed the road would improve public safety access to both Fallon Point and Pine Grove Colony; the August 18, 2004 letter from John W. DeLano and Associates, Inc. recommended approval of the definitive subdivision; the August 2, 2004 memorandum from Water Superintendent Glen Doherty expressed concern with the waivers relative to fire service and the water main; and the August 17, 2004 letter from John DiLillo expressed her regret at being unable to attend the meeting and reiterated her concerns with the potential impact on residents from increased traffic and drainage.

        Howard Bezanson of 543 Maquan Street asked about the role of the Board’s consultant and was told that inspections would be done periodically and was also told that reflective posts would be installed.  He also asked about the location of the well and was told that it would appear on the septic plans submitted to the Board of Health.  He was assured by Mr. Perrault that consideration would be given to the potential impact of the new well on his existing 32 foot deep well.

        Vice Chairman Gerard LeBlanc told the Board that he too had grave public safety concerns because more traffic will be added to Pine Grove Avenue which is not sufficient for the cars that are there already.  He noted that Pine Grove Avenue is a 30 foot wide road with pavement that narrows from 15 to10 feet in a community with 50 houses.  To add vehicles from the nine homes on Fallon Point to the existing traffic on the narrow roadway, he said, is a public safety concern.  Pine Grove Avenue, he said, should be widened from Grove Point Way to Maquan Street.   Mr. Perrault countered that the Board could not require improvements off the subdivision but could ask for stop signs on Grove Point Way or “Do Not Enter”signs at the intersection with Fallon Point Road if it wants to prevent those residents from using this road.  He noted that only one more house was being added to the neighborhood.

        Mr. LeBlanc said he was also concerned with the potential for drainage problems on Fallon Point Road due to the 5% slope of the land.  Pine Grove Avenue goes from elevation 111 to 96 at Maquan Street, he noted, and Fallon Point Road goes down to 93.  He termed the low point of Fallon Point Road a quagmire and said the situation will only get worse.

         Having given all parties an opportunity for input, the Board considered the waivers which appear on the Definitive Subdivision Plan dated April 1, 2004, revised July 19, 2004.
